At modelfans.ai we treat your personal data with the same care we put into the rest of the project: full transparency. This policy explains what data we collect, why, on what legal basis and what rights you have.
1. Data controller
The controller of your data is modelfans.ai, the project that owns this website. For any question regarding this policy or the processing of your data, you can write to info@modelfans.ai.
2. What data we collect
Only the data you give us or choose to turn on, plus the technical log that any visit leaves on the server: · When you join one of our two lists (the Academy list or the “Create your model” waiting list): your email, the language you browse in, the list you choose, whether or not you agree to receive news and offers, the date and time of your consent and the version of this policy at that moment. · If you ask about seat availability at the Academy: your name, your email, your phone or WhatsApp number if you choose to give it, the level you're interested in, your language, the date and time of your inquiry and the version of this policy at that moment. · On the “Create your model” waiting list, only if you want, the design you chose in the configurator (hair, eyes, height, country or ethnicity, features and scene). It describes a fictional character, not you. · The follow-up of your request, which we record ourselves: whether we have contacted you, whether you have joined the channel, whether you have applied for a seat or booked a call, and internal notes about that relationship. · If you buy an Academy place or a pack, the payment gateway sends us your email, the name you pay with and what you bought; your card details never reach us. If you are a student, we also store the lessons you complete and your password, which is never stored in plain text. · If you write in the “Nova” chat: your messages and the assistant's replies, which we store with a random conversation identifier and without your IP. To answer you, your messages are sent to an artificial-intelligence provider (sections 6 and 10). If you leave your email in the chat, the conversation is linked to your email. · If you message us on WhatsApp: your phone number, your WhatsApp profile name and the messages you send us, with their date and time, together with our assistant's replies. · Only if you accept “Measurement” in the cookie banner: the pages you visit, the page or campaign link you come from, your language and whether you sign up on a form, whether the free guide window opens or whether you click the main button on the home page. Each event is stored with a random tab identifier, without your IP or your email. · The server's technical log: as on any website, the server records each request with your IP, the date and time, the page requested, the referring page and the browser you use. We don't buy data from third parties and we don't build profiles.
3. Purpose of processing
We use each piece of data only for the stated purpose: · Academy list: to send you information about the modelfans.ai Academy (enrollment openings, program updates and related content). · Availability inquiries: replying with the information on the level you're interested in and contacting you by email or, if you give us your phone number, by phone or WhatsApp, to talk about seat availability. · “Create your model” waiting list: to let you know when “Create your model” opens and, if you send us your design, to know which model you want so we can prepare it if you order it. If you are only on this list, we do not send you the Academy emails. · Follow-up of your request: to assist you and know where your relationship with the Academy stands. · WhatsApp messages: to reply to you with our assistant “Nova” and, if your number matches the phone you left in an enquiry or a list, to know who you are so we can help you without asking for your details again. · Purchases: to deliver what you bought, give you access to the Academy and meet the legal obligations that come with it. · Measurement, only if you accept it: to learn which pages work and where visits come from, always looking at totals and never at a specific person. · The server's technical log: to keep the site working and secure (detecting errors and abuse). We don't use it to measure visits or to find out who you are. You only receive news and offers from modelfans.ai if you tick the separate, optional box. We do not use your data for anything else.
4. Legal basis
· Lists, news and measurement: your consent (Art. 6(1)(a) GDPR). On the forms you give it by ticking the acceptance box, and without it no data is sent. You accept measurement in the cookie banner (Art. 22.2 of the Spanish Information Society Services Act, LSSI), and it stays off until then. · Follow-up of your request and the server's technical log: our legitimate interest (Art. 6(1)(f) GDPR) in assisting the people who sign up and in keeping the site working and secure. · Availability inquiries: taking steps at your request before entering into a contract (Art. 6(1)(b) GDPR). · Purchases: the performance of the contract (Art. 6(1)(b) GDPR) and compliance with the legal obligations that come with it (Art. 6(1)(c) GDPR). You can withdraw your consent at any time, through the unsubscribe link in the emails or under “Cookie preferences”, without affecting the lawfulness of the processing carried out beforehand. You can also object to the processing based on legitimate interest by writing to us (section 7).
5. Data retention
We keep your email for as long as the list you joined remains active and you have not unsubscribed. If you send us an availability inquiry and don't enroll, we delete your name, your phone number and the levels you asked about 12 months after your last inquiry, and also your email if we only had it because of that inquiry. If you unsubscribe, we delete them straight away. The “Create your model” waiting list closes when we send the opening notice: at that point we delete the emails that were only on that list, along with the design sent with them, except those of people who agreed to receive news and offers, and we delete the design of those who stay. If you unsubscribe, we stop writing to you and delete the design you sent us and the follow-up of your request; we keep only your email marked as unsubscribed, the date you unsubscribed, your language and the proof of your consent (the list, the date you signed up and the version of this policy), so that we respect your decision and can show that you gave it. If you have bought something, unsubscribing from our emails does not delete your purchase data or your customer relationship with us, which are kept as explained below. If you request erasure, we delete your record. For the records we delete when the waiting list closes, we keep only minimal proof of consent (an internal number, an irreversible digest of the email from which the email cannot be recovered, the date and time and the policy version) for 3 years, the limitation period for the most serious infringements under Spanish data protection law; after that it is deleted. We keep purchase data for the periods required by tax and commercial law. Measurement data is not linked to your email or your IP, and we delete it after 30 days. The server's technical log is deleted after 14 days.
6. Recipients and transfers
We do not sell your data or share it with anyone for their own purposes. For the site to work, these providers process only the data that is strictly necessary: · the hosting provider, with servers in the European Union, where the site, our database and the server's technical log are; · the email providers we use to send you emails and to receive the ones you write to us; · the payment gateway, only if you buy something: it handles the payment and your card details, which never reach us; · the artificial-intelligence provider of the “Nova” chat, only if you write in it: it receives your messages, together with the earlier ones in the same conversation, to generate the reply. · WhatsApp (Meta), only if you message us on WhatsApp: it carries your messages and our replies, which are generated with the same artificial-intelligence provider as “Nova”. WhatsApp may process data in the United States and is certified under the EU-US Data Privacy Framework explained below. The email providers and the payment gateway may process data in the United States. All of them participate in the EU-U.S. Data Privacy Framework, which the European Commission recognises as providing an adequate level of protection (adequacy decision of 10 July 2023, Art. 45 GDPR), and the transfer relies on it. We don't use advertising providers or third-party analytics tools. The chat's artificial-intelligence provider processes your messages outside the European Economic Area, in China, a country without an adequacy decision from the European Commission, and we have not signed any additional safeguards with it, such as standard contractual clauses (Art. 46 GDPR). This means your messages may not enjoy protection equivalent to the GDPR there. Don't write personal data in the chat; if you don't want your messages to leave the European Economic Area, don't use it and write to us at info@modelfans.ai.
7. Your rights
You can exercise your rights of access, rectification, erasure, objection, restriction of processing and portability at any time by writing to info@modelfans.ai. You also have the right to lodge a complaint with the competent supervisory authority (in Spain, the Spanish Data Protection Agency, aepd.es) if you believe the processing does not comply with the law.
8. Security
We apply reasonable technical and organizational measures to protect your data: encrypted connections (HTTPS), restricted access to the database and the server, and minimization of the data collected (only what is strictly necessary).
9. Changes to this policy
If we modify this policy, we will update its version number and, if the change affects the processing of your data, we will notify you by email before it takes effect. The current version is always published on this page.
10. AI chat assistant
The “Nova” chat on this website is an automated assistant: what you write, together with the earlier messages in the same conversation, is sent to an artificial-intelligence provider with the sole purpose of generating the reply you see on screen. That provider processes the messages outside the European Economic Area, in China, as explained in section 6. We store conversations in our database, with a random conversation identifier and without your IP, to improve the Academy's support; they have no automatic deletion period and you can ask us to delete yours at any time (section 7). If you leave your email in the chat, the conversation is linked to your email and becomes part of the follow-up of your request: for example, if you show interest in a seat in it, we note it. The legal basis is our legitimate interest in answering your questions and handling your request (Art. 6(1)(f) GDPR). Don't type sensitive data into the chat: we only need your email, and only if you choose to leave it in the form with your consent. “Nova” also replies to the messages you send us on WhatsApp, under the same rules: your messages, together with the earlier ones in the conversation, go to the same artificial-intelligence provider (in China, section 6) to generate the reply. We store that conversation linked to your phone number and, if it matches the one you left in an enquiry or a list, linked to it as well. You can ask us to delete it whenever you want (section 7).
